In the context of the adoption of Law no. 279/2005 on work apprenticeship, which regulates the control over the apprenticeship activity, the legal status of the apprentice, the way the apprenticeship contract is concluded and performed, the final assessment of the apprentice’s aptitudes, as well as other aspects related to the apprenticeship contract, it is important to analyze the application of legal provisions concerning the disciplinary liability of the apprentices in the legal systems of certain European states. The present study contains also a presentation of the evolution of these provisions in the Romanian labor law.
By analyzing the legal provisions concerning the disciplinary liability of the apprentices within the labor law of certain European states (France, Belgium, Switzerland) and the evolution of Romanian labor law in this matter, as well as its present regulation - the Law no. 279/2005 and the Labor Code – one can emphasize that the apprenticeship contract is a specific kind of contract which entails a particular liability.
