Abstract:  
The model of organizing the functioning of cooperation as a specific sector of economy at national and territorial level is regulated by Law no. 1/2005. They are excepted from the law the cooperatives of credit and the central houses of cooperatives of credit, those being ruled by special laws. According to the article 4 of the law, the cooperative societies are formed as cooperatives of first and of second degree. The first degree cooperatives are formed under the form of: manufacturer cooperatives societies, consummation sales, houses, fishnets, transports, etc. The law said that the second degree cooperatives societies, legal persons are formed from first degree cooperative societies in majority and other fiscal and legal persons. The law is presented as a juridical puzzle having elements from Law no. 31/1990, from the French law concerning the agricultural enterprise with unique associate and the Belgian law concerning the agricultural societies.
