Abstract:
The paper aims to offer a comparative approach on the concept of credit institution in the Romanian law, in the EU law and in the US law. The Romanian law had to be pursuant to the EU Law and in order to accomplish this purpose, the rules regarding banking activities in Romania were compliant to he directives of the European Union in this field. The concept of the credit institution in the Romanian law and in the EU law appeared as a necessity to coordinate the activity of credit institutions. In the American banking law, a synonym to the credit institution may be depository institution (a concept that includes all institutions that accept deposits from the public, such as commercial banks, savings nd loans, saving banks, credit unions). Credit institutions and depository institutions are the main actors on the financial market. A study has to be made in order to decide upon the proper regulatory regime of these institutions, because the regulatory regime has a strong influence on the financial market.
