Abstract:  

This study is organized as follows: the introduction presents briefly the historical evolution of the regulation of the European company. The first part demonstrates that the accomplishment of the internal market and the positive consequences it determines throughout the Community on the economic and social situation imply not only the removal of any barriers to trade, but also the adaptation of production structures to the Community dimension. The second part contains a synthetic analysis of the main aspects concerning the application of Council Regulation (EC) no. 2157/2001 of 8 October 2001 on the Statute for a European company and the Council Directive no. 2001/86/EC of 8 October 2001 supplementing the Statute for a European company with regard to the involvement of employees. The third part refers to the obligation of Member States to ensure the observance of legal provisions applicable to European companies according to the European regulation.
