Abstract:

The legislation concerning the insurance contract for civil liability for damaging or destroying goods has been modified more than one time. Thus, the Law no. 136/1995 was primarily adopted, but it was modified by Law no. 172/2004, Emergency Ordinance no. 61/2005 and Law no. 283/2005.

The novelty in this area is represented by the provisions concerning the compulsory insurance concluded by the Romanian insurance companies which are recognized by the competent authorities of the EU Member States, in accordance with the principle of free circulation of services.

According to the provisions of the Emergency Ordinance no. 61/2005, the persons that have cars which are registered abroad are considered as being insured starting from the date of their entrance on the territory of Romania.
