Abstract:
Through the clemency policy, the Romanian legislator tried to find the appropriate instruments for discouraging the practices of the firms to constitute in anti-competition cartels. In this regard, there were created two modalities to determine them to denounce the existence of such agreements: allotting the immunity to the penalty for the first company that will bring elements with probative value regarding the illegal activity and giving the reduction of the amount of penalty for the other companies which cannot be framed for the immunity to penalty. These facilities are granted according to pre-established conditions and in specific ranks.
