The correlation between the liability regulated by Law no. 31/1990 on commercial companies and the liability regulated by the Labor Code – the Law no. 53/2003 has not been the object of a distinct analysis in the juridical doctrine. The obvious inconsistency which exists between the provisions of the commercial legislation and those of the labor legislation, as well as the irreconcilable opinions expressed on this matter in the juridical doctrine are the main reasons for which this study analyses the correlation between the liability of the administrators as provided by Law no. 31/1990 and the liability of the administrators – employees regulated by the Labor Code.
